Terms of Service

These Terms of Service ("Terms") govern your use of Pitolet (the "Service"), a web-native design tool operated by a sole proprietor ("we", "us", "Pitolet"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Your account
You are responsible for your account, for keeping your credentials secure, and for all activity that happens under it. You must provide accurate information and be old enough to form a binding contract in your jurisdiction. Tell us promptly at [email protected] if you suspect unauthorized access.
2. Acceptable use
You agree not to:
- break the law or infringe anyone's rights using the Service;
- upload malware, or attempt to disrupt, overload, or reverse-engineer the Service (beyond rights granted by the open-source license);
- abuse, probe, or circumvent our security, rate limits, or access controls;
- use the Service to store or distribute unlawful, infringing, or harmful content;
- resell or provide the hosted Service to third parties except as expressly permitted.
We may suspend accounts that put the Service or other users at risk.
3. Your content and designs
Your designs are yours. You retain all ownership of the documents, designs, tokens, and other content you create or upload ("Your Content"). You grant us only the limited license needed to host, process, back up, and display Your Content so we can operate the Service for you. We do not claim ownership of Your Content and we do not sell it.
You are responsible for having the rights to Your Content and for exported code you ship from it.
4. Subscriptions and billing
Paid plans are billed through Paddle, which acts as the merchant of record for purchases. Paddle handles payment processing, invoicing, and applicable sales tax/VAT, and your purchase is also subject to Paddle's terms. Subscriptions renew automatically for the billing period you selected until cancelled.
- You can cancel anytime; access continues until the end of the paid period.
- Fees are stated exclusive of taxes unless noted; taxes are added at checkout where required.
- Except where required by law, payments are non-refundable. Refund requests can be sent to [email protected].
- We may change prices with reasonable notice; changes apply to the next billing period.
5. Free and self-hosted use
The Pitolet core is open source under the AGPL-3.0 license. You may self-host it under the terms of that license, which includes the obligation to make source available to users you provide the software to over a network. The AGPL governs the self-hosted software; these Terms govern the hosted Service we operate.
6. Service changes and availability
We may add, change, or remove features, and we aim for high availability but do not guarantee uninterrupted service. Planned and unplanned downtime can occur.
7. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you materially breach these Terms or use the Service in a way that harms others or us. On termination you can request an export of Your Content for a reasonable period, after which it may be deleted.
8. Disclaimers and limitation of liability
The Service is provided "as is" without warranties of any kind, to the maximum extent permitted by law. To the maximum extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim, and we are not liable for indirect, incidental, or consequential damages. Nothing limits liability that cannot be limited by law.
9. Governing law
These Terms are governed by the laws of South Africa, without regard to conflict-of-law rules. Disputes will be handled by the courts of South Africa, unless mandatory local law provides otherwise.
10. Changes to these Terms
We may update these Terms; material changes will be notified through the Service or by email. Continued use after changes take effect means you accept the updated Terms.
